LUX&MO is operated by World Link Co., Ltd. The terms “we,” “us,” and “our” refer to World Link Co., Ltd. World Link Co., Ltd. operates this store and website, including all related information, content, features, tools, products, and order services, to provide customers with a curated shopping experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with the policies referenced here (collectively, the “Terms”), describe your rights and responsibilities when using the Services.

Please read these Terms carefully. They contain important information about your legal rights, including disclaimers of warranties and limitations of liability.

By visiting, accessing, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you must not use or access our Services.

Section 1 - Access and Accounts

By agreeing to these Terms, you represent that you are at least the age of majority in the state, province, or region where you reside, and that you consent to allowing any minor dependents under your care to use the Services on devices that you own, purchase, or control.

To use the Services, including accessing or browsing our online store or purchasing products or services offered by us, you may be required to provide certain information, such as your email address, billing information, payment information, and shipping information.

You represent and warrant that all information you provide to our store is accurate, current, and complete, and that you have all rights necessary to provide that information.

You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or license your account to any other person.

Section 2 - Our Products

LUX&MO specializes in pre-owned luxury goods. Each item is unique and may show normal signs of age, storage, or previous use.

We make every effort to accurately represent each pre-owned item through product photos, descriptions, and condition notes. Conditions and signs of use that are clearly disclosed in the product photos, descriptions, or condition notes are considered part of the product description.

Colors and appearance may vary slightly depending on the device, screen, and display settings you use to access our store.

LUX&MO is committed to selling authentic pre-owned luxury goods. Each item is subject to our authentication process before being offered for sale.

Certain products may also be eligible for optional third-party authentication services at an additional charge. These services are supplementary and do not replace LUX&MO’s own authentication process.

All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit the quantities of products offered to any person, geographic region, or jurisdiction on a case-by-case basis.

Nothing in this section limits any rights you may have under our Refund Policy or applicable law where an item has a serious undisclosed defect or is materially different from its product photos or description.

Section 3 - Orders

When you place an order, you are making an offer to purchase. World Link Co., Ltd. reserves the right to accept or reject your order for legitimate reasons, including product availability, payment issues, suspected fraud, pricing or listing errors, or other circumstances that prevent us from fulfilling the order.

An order is not accepted until we confirm acceptance and successfully process the applicable payment.

Many of our pre-owned items are unique and available in limited quantities. In rare cases, an item may become unavailable after an order is placed. If we are unable to fulfill your order, we will notify you and issue a refund for the unavailable item.

Please review your order carefully before submitting it.

If your order has not yet been shipped, please contact us as soon as possible to request a cancellation. Once an order has shipped, cancellation may no longer be possible, and the applicable Refund Policy will apply.

Returns, refunds, and any optional return services, including Premium Return Service, are subject to our Refund Policy.

If we reject, modify, or cancel an order, we will attempt to notify you using the email address, billing information, and/or phone number provided at the time the order was placed.

Section 4 - Prices and Billing

Prices, discounts, and promotions are subject to change without notice.

The price charged for a product or service will be the price in effect when the order is placed and will be stated in the order confirmation.

For retail orders shipped to the United States, Australia or Canada, product prices include applicable import duties and import taxes (including import VAT or GST where applicable). LUX&MO covers these charges, so the recipient does not need to pay additional import duties or import taxes on delivery.

For all other destinations, product prices exclude applicable import duties and import taxes. Any such charges are payable by the recipient. This does not mean that domestic sales or consumption taxes are exempt.

This treatment is based on the actual shipping destination. Please select the market matching your delivery address before ordering. If the destination changes, contact us to confirm the revised price and delivery arrangements before dispatch.

Shipping and handling fees, where applicable, are separate from import duties and taxes. Please refer to our Shipping Policy for retail orders.

Prices listed in the online store may differ from prices offered in physical stores, other online stores, or stores operated through third-party services.

From time to time, we may offer promotions relating to the Services that are subject to separate terms in addition to these Terms. If there is a conflict between the terms of a promotion and these Terms, the promotion terms will control with respect to that promotion.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made through our store.

You also agree to promptly update your account and other information, including your email address and payment information, so that we can complete transactions and contact you as needed.

You represent and warrant that you are authorized to use the payment method provided for your purchase and that the information you provide is accurate and complete.

Section 5 - Shipping and Delivery

All delivery times are estimates and are not guaranteed.

We are not responsible for shipping or delivery delays caused by carriers, customs procedures, weather conditions, or other circumstances beyond our reasonable control.

Shipping methods, estimated delivery times, customs treatment, and other shipping-related matters are subject to our Shipping Policy.

Section 6 - Intellectual Property

The Services, including without limitation all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement of those materials, are owned by World Link Co., Ltd., its affiliates, or its licensors and are protected by applicable intellectual property laws.

These Terms permit you to use the Services only for personal, non-commercial purposes.

Without our prior written consent, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit materials from the Services except as permitted by applicable law.

Except as expressly provided in these Terms, nothing in these Terms grants any license or other right under any patent, trademark, copyright, or other intellectual property right of World Link Co., Ltd., LUX&MO, Shopify, or any third party.

The LUX&MO and World Link names, logos, service names, designs, and slogans may be trademarks or other protected intellectual property of their respective owners. You may not use those marks without applicable permission.

The Shopify name, logos, product names, service names, designs, and slogans are trademarks of Shopify. All other names, logos, product names, service names, designs, and slogans appearing in the Services are trademarks of their respective owners.

Section 7 - Optional Tools and Services

As part of the Services, we may provide access to tools or services offered by third-party providers.

We do not necessarily monitor, control, or have input over those third-party tools or services.

You acknowledge that third-party tools and services may be subject to separate terms and policies provided by the relevant third-party provider. You should review those terms before using such tools or services.

To the extent permitted by applicable law, we are not responsible for matters arising solely from third-party tools or services that are outside our reasonable control.

We may also offer new features, services, tools, or resources through the Services in the future. Such features will be considered part of the Services and will be subject to these Terms where applicable.

The Services may contain materials and hyperlinks to websites provided or operated by third parties, including embedded third-party service features.

We are not responsible for examining or evaluating the content or accuracy of third-party websites that you choose to access.

To the extent permitted by applicable law, we are not responsible for harm or damages arising solely from third-party websites, products, services, resources, or content that are outside our reasonable control.

Questions or concerns regarding third-party products or services should be directed to the relevant third party.

Section 9 - Relationship with Shopify

LUX&MO is operated by World Link Co., Ltd. and powered by Shopify, which enables us to provide the Services to you.

Sales and purchases made through our store are conducted directly between you and World Link Co., Ltd.

By using the Services, you acknowledge that Shopify is not the seller of the products purchased through LUX&MO and is not responsible for the sale between you and World Link Co., Ltd., except to the extent required by applicable law.

Section 10 - Privacy Policy

Personal information we receive through the Services is handled in accordance with our Privacy Policy and applicable data protection laws.

Because our store is powered by Shopify and may use third-party service providers, certain personal information may be processed by Shopify or other service providers as necessary to operate, secure, process payments for, fulfill, and improve the Services.

Section 11 - Feedback and Customer Content

If you submit reviews, photographs, videos, suggestions, comments, feedback, or other content to us, you represent that you own or have the necessary rights to submit that content.

You are responsible for the accuracy and legality of content you submit.

We may suspend or terminate your access to the Services, or any part of them, where reasonably necessary, including where you materially violate these Terms, engage in unlawful or fraudulent activity, or create security or operational risks.

You remain responsible for amounts properly due for transactions completed before termination.

Provisions that by their nature should survive termination, including intellectual property, liability, indemnification, governing law, and related provisions, will continue to apply.

Section 15 - Disclaimer of Warranties

Information provided through the Services is for general informational purposes. While we make reasonable efforts to keep information accurate and current, we do not guarantee that all information will always be complete, current, or error-free.

Our products are pre-owned and may show normal signs of age, storage, or previous use. Conditions and imperfections clearly disclosed in product photos, descriptions, or condition notes form part of the product description.

Nothing in these Terms limits your rights under our Refund Policy where an item has a serious undisclosed defect, is the wrong item, or is materially different from its product photos or description.

To the extent permitted by applicable law, the Services are otherwise provided on an “as is” and “as available” basis, without warranties that are not expressly stated in these Terms or required by applicable law.

Nothing in these Terms excludes warranties, rights, or remedies that cannot lawfully be excluded.

Section 16 - Limitation of Liability

To the fullest extent permitted by applicable law, World Link Co., Ltd., LUX&MO, our affiliates, directors, officers, employees, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including loss of profits, revenue, data, or business opportunities, arising from your use of the Services or products purchased through the Services.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Nothing in this section limits your rights or remedies under our Refund Policy in relation to an eligible return, refund, incorrect item, serious undisclosed defect, or item that is materially not as described.

Section 17 - Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless World Link Co., Ltd., LUX&MO, and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, or reasonable costs arising directly from:

Your material breach of these Terms;
Your violation of applicable law;
Your infringement of a third party’s rights; or
Your intentional, fraudulent, abusive, or otherwise improper use of the Services.

This section does not apply to claims arising solely from your ordinary and lawful use of the Services.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law or severed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

These Terms, together with the policies and other terms expressly incorporated by reference, constitute the agreement between you and us regarding your use of the Services and supersede prior agreements or communications relating to the same subject matter.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent where such consent is permitted to be required by applicable law.

We may transfer or assign our rights and obligations under these Terms in connection with a merger, corporate reorganization, sale or transfer of our business, or similar legitimate business transaction.

Any such transfer will not reduce the rights you already have under these Terms or applicable law.

Section 21 - Governing Law and Jurisdiction

These Terms and disputes relating to the Services are governed by the laws of Japan.

Subject to applicable law, the district court having jurisdiction over the location of the head office of World Link Co., Ltd. will have agreed jurisdiction as the court of first instance for disputes arising in connection with these Terms or the Services.

Nothing in this section affects any mandatory rights, protections, or remedies available to consumers under applicable law.

The headings used in these Terms are included for convenience only and do not limit or otherwise affect the meaning or scope of these Terms.

We may update, change, or replace portions of these Terms from time to time by posting an updated version on our website.

Where required by applicable law, we will provide notice of material changes.

Unless required by applicable law or expressly agreed with you, changes to these Terms will not retroactively affect orders placed before the updated Terms take effect.

Your continued use of the Services after updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by applicable law.
